DMCA Copyright Policy

Copyright Policy

This DMCA Copyright Policy forms part of the CopyWins Terms of Service and Creator Agreement. Capitalized terms not defined in this Policy have the meanings assigned to them in those agreements.

CopyWins Inc. ("CopyWins," "we," "our," or "us") respects the intellectual property rights of others and expects all users, creators, providers, and visitors to do the same.

CopyWins complies with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512, and maintains a Designated Copyright Agent registered with the United States Copyright Office to receive notifications of claimed copyright infringement.

CopyWins is a technology platform that hosts user-generated content. Creators are solely responsible for the content they upload, publish, distribute, or otherwise make available through the platform.

By using CopyWins, all users acknowledge that unauthorized uploading, copying, distribution, sale, reproduction, or use of copyrighted material is strictly prohibited.

Reporting Copyright Infringement

If you believe that any content available on CopyWins infringes your copyright, you may submit a written DMCA Notice to our Designated Copyright Agent.

Your notice must include:

1. Your physical or electronic signature.

2. Identification of the copyrighted work claimed to have been infringed.

3. Identification of the allegedly infringing material, including the specific URL or sufficient information to locate the content.

4. Your full legal name, mailing address, telephone number, and email address.

5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or applicable law.

6. A statement, under penalty of perjury, that the information contained in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

Incomplete or inaccurate notices may delay processing or prevent us from taking action.

Our Response

Upon receipt of a facially valid DMCA notice, CopyWins may, in its sole discretion:

• Remove or disable access to the reported content.

• Suspend or restrict access to the content while the claim is reviewed.

• Notify the creator responsible for the content.

• Request additional information from either party.

• Preserve evidence relating to the reported content.

• Cooperate with copyright owners, law enforcement, or governmental authorities where required by applicable law.

• Take any additional action permitted under applicable law, our Terms of Service, Creator Agreement, or other platform policies.

CopyWins reserves the right to remove or disable content at any time where it reasonably believes the content may infringe the rights of another or otherwise violate applicable law or our policies.

Counter-Notification

If you believe your content was removed due to mistake or misidentification, you may submit a counter-notification under the DMCA.

Your counter-notification must include:

• Your physical or electronic signature.

• Identification of the removed material and its location before removal.

• A statement under penalty of perjury that you have a good-faith belief the material was removed due to mistake or misidentification.

• Your name, mailing address, telephone number, and email address.

• A statement consenting to the jurisdiction of the Federal District Court for your judicial district or, if you reside outside the United States, the United States District Court for the District of Delaware.

• A statement that you will accept service of process from the person who submitted the original DMCA notice or their authorized representative.

Where permitted by law, CopyWins may restore removed content after receiving a valid counter-notification unless the complaining party notifies us that it has filed a legal action seeking to restrain the allegedly infringing activity.

Repeat Infringer Policy

CopyWins maintains a strict repeat infringer policy.

Accounts that repeatedly upload, publish, distribute, or otherwise make available content that infringes the intellectual property rights of others may be suspended or permanently terminated without prior notice.

CopyWins may also suspend or terminate accounts that repeatedly receive copyright complaints, attempt to circumvent enforcement actions, or otherwise misuse the platform in violation of applicable intellectual property laws, our Terms of Service, Creator Agreement, or other platform policies.

Creator Responsibility

Creators are solely responsible for ensuring they possess all rights, licenses, permissions, and legal authority necessary to upload, distribute, sell, monetize, or otherwise exploit any content published through CopyWins.

By uploading content, creators represent and warrant that:

• They own the content or possess all necessary legal rights.

• Their content does not infringe the rights of any third party.

• They have obtained all necessary licenses, permissions, and releases.

• They assume full legal responsibility for the content they publish.

Creators agree to indemnify, defend, and hold harmless CopyWins from any claims arising from content they upload, as set forth in the applicable Creator Agreement.

Abuse of the DMCA Process

CopyWins reserves the right to reject, disregard, or request additional information regarding any notice or counter-notification that is incomplete, fraudulent, submitted in bad faith, or otherwise fails to comply with applicable law.

Repeated abuse of the DMCA process may result in account suspension, termination, legal action, or any other remedy available under applicable law.

False Claims

Submitting knowingly false, misleading, fraudulent, or bad-faith DMCA notices or counter-notifications may result in civil or criminal liability under applicable law.

CopyWins reserves all rights available under the DMCA and other applicable laws to protect itself, its users, creators, and the integrity of its platform against abusive or fraudulent copyright claims.

Reservation of Rights

Nothing in this Policy limits any other rights or remedies available to CopyWins under applicable law, our Terms of Service, Creator Agreement, Content Policy, or any other applicable agreement or policy.

CopyWins reserves the right to investigate any alleged infringement, preserve relevant records, cooperate with copyright owners, payment processors, hosting providers, governmental authorities, and law enforcement where appropriate, and take any action it reasonably deems necessary to protect its platform, users, intellectual property rights, and legal interests.
